MyMahotsav Affiliate Program Terms and Conditions

Introduction

Welcome to the MyMahotsav Affiliate Program! By participating in our program, you agree to these terms and conditions, which govern your relationship with MyMahotsav and outline your rights and responsibilities as an affiliate. 

Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to MyMahotsav FutureTech Ltd. by your own website or personal referrals.

By signing up for the MyMahotsav FutureTech Ltd. Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Definitions

• “MyMahotsav” refers to MyMahotsav FutureTech Limited, the operator of the affiliate program.
• “Affiliate” refers to the individual or entity participating in the affiliate program.
• “Affiliate Link” refers to a unique tracking link provided by MyMahotsav to the affiliate for promoting MyMahotsav’s products and services.
• “Commission” refers to the monetary compensation earned by an affiliate for successful referrals that lead to sales or customer sign-ups.
• “Customer” refers to an individual who completes a transaction with MyMahotsav through an affiliate referral.
• “Affiliate Program” refers to the MyMahotsav Affiliate Program.
• “Affiliate Dashboard” refers to the platform where affiliates can manage their participation, track referrals, and access marketing materials.

Non-Exclusivity

Participation in the MyMahotsav Affiliate Program is non-exclusive. Both you and MyMahotsav have the right to work with other parties, including similar affiliate programs.

Affiliate Acceptance

Acceptance into the MyMahotsav Affiliate Program is at MyMahotsav’s discretion. If accepted, you will receive a notification, allowing you to start promoting MyMahotsav products through affiliate links. If you do not receive an acceptance notification within 30 days, your application is considered declined.

Affiliate Obligations

Eligibility

To participate in the MyMahotsav Affiliate Program, you must:

• Be at least 18 years old.
• Complete the online application and meet the program requirements.
• Have a valid payment method and complete any required tax documentation.

Compliance and Conduct

Affiliates must comply with all applicable laws and regulations, including advertising, intellectual property, and privacy laws. You must not:

• Engage in fraudulent or deceptive practices.
• Use misleading or unethical promotional techniques.
• Engage in “spam” marketing or other prohibited practices.
• Misrepresent your relationship with MyMahotsav.

Content Restrictions

Affiliate websites or promotional materials must not contain:

• Offensive, defamatory, or illegal content.
• Adult or obscene content.
• Content that infringes on intellectual property rights.
• Content that encourages illegal activity or violates the law.

MyMahotsav Affiliate Program: Commission and Payment

• Commission Structure: Commissions are earned based on successful referrals resulting in sales or customer sign-ups through your affiliate links.
• Payment Schedule: Commissions are paid monthly, provided the minimum payout threshold is met. If not, the commission will be carried over to the next month.
• Payment Method: Payments are made through the affiliate dashboard. Ensure your payment information is accurate and up-to-date.
• Chargebacks and Refunds: Commissions on transactions resulting in chargebacks or refunds will be voided.
• Payout and Points: Commissions on transactions can also be paid as points; the monetary or equivalent value is updated occasionally without prior notice..

Coupon and Deal Sites

MyMahotsav FutureTech Ltd. occasionally offers coupon to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

• Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
• Affiliates may not bid on MyMahotsav FutureTech Ltd. Coupons, MyMahotsav FutureTech Ltd. Discounts or other phrases implying coupons are available.
• Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
• User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
• Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

MyMahotsav Affiliate Program: Termination

Termination by Either Party

Both you and MyMahotsav may terminate the agreement at any time with 15 days’ notice. Upon termination, you must cease all use of MyMahotsav branding and remove all affiliate links from your platforms.

Termination for Cause

MyMahotsav reserves the right to terminate your participation immediately if you engage in fraudulent activity, violate these terms, or conduct activities that harm MyMahotsav’s reputation.

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
• Spamming (mass email, mass newsgroup posting, etc.).
• Advertising on sites containing or promoting illegal activities.
• Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
• Violation of intellectual property rights. MyMahotsav FutureTech Ltd. reserves the right to require license agreements from those who employ trademarks of MyMahotsav FutureTech Ltd. in order to protect our intellectual property rights.
• Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with MyMahotsav FutureTech Ltd., however, is acceptable.
• Self referrals, fraudulent transactions, suspected Affiliate fraud.

In addition to the foregoing, MyMahotsav FutureTech Ltd. reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

Proprietary Rights and Trademarks

MyMahotsav retains all ownership rights in its products and content. Affiliates are granted a limited, non-exclusive license to use MyMahotsav branding and trademarks in accordance with the program terms.

Affiliate Links and Creatives

You may use graphic and text links both on your website and within in your email messages. You may also advertise the MyMahotsav FutureTech Ltd. site in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.

Pay Per Click (PPC) Policy

PPC bidding is NOT allowed without prior written permission.

Indemnification

You agree to indemnify and hold MyMahotsav harmless from any third-party claims arising from your participation in the affiliate program, including but not limited to intellectual property infringement or violations of these terms.

Confidentiality

Any confidential information shared with you during the affiliate program must be kept confidential. This includes customer data and other sensitive information.

Miscellaneous

Changes to Terms

MyMahotsav may update or modify these terms at any time. Changes will be communicated via email or the affiliate dashboard. Continued participation in the affiliate program after changes are made constitutes your acceptance of the new terms.

Applicable Law

These terms are governed by the laws of the United Kingdom. Any disputes will be resolved in the United Kingdom.

Assignment

Affiliates may not assign or transfer their rights under this agreement without MyMahotsav’s prior consent.

Liability

MyMahotsav FutureTech Ltd. will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by MyMahotsav FutureTech Ltd.. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

Force Majeure

Neither party will be liable for delays or failures due to circumstances beyond their control, such as natural disasters, war, or governmental restrictions.

Indemnification

Affiliate shall indemnify and hold harmless MyMahotsav FutureTech Ltd. and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by MyMahotsav FutureTech Ltd. to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the MyMahotsav FutureTech Ltd. affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the MyMahotsav FutureTech Ltd. application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.

Entire Agreement

This agreement constitutes the entire agreement between MyMahotsav and the affiliate, superseding any prior agreements or understandings.

No Third-Party Beneficiaries

This agreement does not create any third-party rights or benefits. The agreement is between MyMahotsav and the affiliate.
